Privacy notice

Your privacy is very important to Agriness Sistemas e Tecnologias da Informação SA (“Agriness”). Therefore, we have developed this Privacy Notice, which sets out how we collect, use, share, protect, transfer and store your personal data when you interact with us through our channels, products and services. 

 

  1. How do we collect personal data?

Personal data is collected directly from you, through forms you fill out on the web, contracts entered into with us and the use of our products and services.

We also collect data automatically, through Cookies related to our Site and our Platform. Below, in item 10, you have access to our Cookies policy.

 

  1. What types of data are collected and for what purpose?

The types of data collected depend on the type of relationship you have with Agriness.

(i) Customers. If you are an Agriness customer, we collect personal data so that we can provide our services and perform our contract with you. The data collected for contract purposes are name, surname, CPF, sex, marital status, nationality, home address, telephone number, e-mail.

On occasion, we may send you satisfaction surveys so that you can express your opinion on the quality of our services, at which time we may request and collect any other information you choose to share with us.

From time to time, with your consent, we may use your data for the improvement and/or development of new products, services and events. In activities of this nature, we take care to use your data without identifying you, that is, anonymized data is used.

(ii) Interested parties. If you – Agriness customer or not – are interested in receiving information about our products, services and events, as well as news related to our activities, we collect and use your name and email so that we can communicate with you. In addition, when we organize specific events, such as the “Melhores da Suinocultura”, we may collect other personal data, such as city, state, country, telephone number, company and language. In all these cases, data is collected with your consent for each specific purpose.

(iii) Users. Anyone accessing our applications and/or websites will automatically have the following browsing data collected: IP address; date and time of access and execution of actions on the application/website; geolocation data; device identification; type of mobile device; browser type and language; clickstream data; and access time and interaction with the website.

 

  1. How do we use your personal data?

In all cases, we will use your personal data only for the following cases:

  1. a) Identify and authenticate the data subject;
  2. b) Provide the information requested by the holder, by filling in data on the Agriness Platform;
  3. c) Fulfill the obligations arising from the contract signed with Agriness;
  4. d) Expand our relationship, inform you about news, features, content, news and events that we consider relevant to you;
  5. e) Enrich your experience with Agriness, as well as promote our products and services;
  6. f) Protect your data by performing fraud prevention, credit protection and associated risks, in addition to complying with legal and regulatory obligations;
  7. g) Comply with legal obligations to maintain records established by the Marco Civil da Internet – Law 12.965/2014.

We treat all your information with the utmost confidentiality. We do not disclose, without prior authorization, except in the cases provided for in this Notice, personal information and/or the e-mail address of the holder who registers on Agriness pages that require filling in this data.

We preserve your identity, maintaining confidentiality while browsing the platform.

We do not sell, in any way, any of your individual information to third parties.

 

  1. Who do we share your data with?

For Agriness to fulfill its mission and bring prosperity to the countryside, it counts on the support of partner companies. In addition, it interacts with various public authorities. In this way, it may share personal data as described below:

(i) Our suppliers and partners

Your data may be shared with Agriness suppliers and partners, who are hired to facilitate, provide or perform activities related to the company’s business. Agriness seeks to evaluate its suppliers and partners carefully and enter into contractual obligations with them for information security and protection of personal data, in order to minimize risks associated with the protection and privacy of personal data.

(ii) Agriness Edge

Your personal data may be shared with Agriness Edge, a company controlled by Agriness that develops and sells specialized IoT technologies for animal production and that meets the demands and needs of the Agriness Platform.

(iii) Advertising companies and analysis services

Agriness may share your data, in an aggregated and anonymized way, with companies specialized in marketing and data analysis. Personal data, when aggregated and anonymized, can be freely shared as they do not identify the data subject.

(iv) Public Authorities

Your personal data may also be shared with competent judicial, administrative or governmental authorities, whenever there is a legal determination, petition, request or court order. 

 

  1. How long do we retain your personal data?

If you are an Agriness customer, we keep your personal data for as long as Agriness’ contractual relationship with you lasts, and after this relationship is terminated, for the period necessary to comply with legal or regulatory obligations to which the company is subject, or for the preservation of rights, including those determined by the Brazilian Association of Technical Standards (ABNT).

After the processing personal data purpose is finished, the information will be discarded or anonymized, according to the appropriate policies used for this purpose.

 

  1. Responsibility for Data Processing and Transfers

Agriness is responsible for the processing of personal data in all countries in which it operates.

Therefore, the database, formed through data collection, is our property and under our responsibility, and its use, access and sharing, when necessary, will be made within the limits and business purposes described in this Notice and in the General Law for the Protection of Personal Data – 13.709/2018 (LGPD).

Data collected in Brazil remains hosted on servers located in the country. Data originating from other countries are transferred to Brazil, where they are hosted.

The data provided by the holder to our partners, who eventually offer services through functionalities or websites that can be accessed from the Platforms, will be their responsibility, and are therefore subject to their own data collection and use practices.

If outsourced companies process any personal data we collect on our behalf, they must undertake to respect the conditions stipulated herein and the information security standards.

 

  1. Personal Data Protection

To guarantee your privacy and the protection of your personal data, Agriness adopts a set of security measures:

  • Isolation: access to personal data is restricted to authorized employees, and only the data necessary to carry out the intended activity is made available.
  • Prevention: the company adopts a set of preventive procedures against information security incidents, as well as remediation and crisis management techniques.
  • Security incident reporting: the company has an internal procedure for the notification and management of security incidents. In the event of a security incident that may cause relevant risk or damage to the data subject, Agriness will notify the National Data Protection Authority (ANPD) and, as the case may be, the data subject, within a reasonable period, with the description of the nature of the affected personal data, indication of technical and security measures used for data protection, related risks and actions taken to reverse or mitigate the effects of the damage.

 

  1. What are your rights as a data subject?

The law guarantees you a set of rights related to your personal data, which can be exercised through a form available on the Privacy Portal on our website (www.agriness.com). They are the following:

Confirmation of the existence of data: you can request confirmation of the existence of personal data collected and processed by the company.

Data access: you can request access to your personal data collected and processed by the company.

Updating and correcting data: you can request to update, correct or supplement any information regarding your personal data that is processed by the company.

Restriction of unnecessary data: you can request the anonymization, blocking or deletion of unnecessary, excessive data or that you believe is being treated by the company in violation of the law.

Deletion of data: you can request the deletion of your personal data processed by the company, as long as the company is not obliged to keep them in order to comply with any legal or regulatory obligation in force.

Automated decision review: You can request information regarding the criteria and procedures used for automated decision.

Data portability: You can request the transfer of your personal data to another provider.

Sharing Information: You may request information regarding the sharing of your personal data with other entities.

Revocation of consent: you can request the revocation of authorization for the processing of your personal data, for a processing activity to which you have previously consented.

Whenever you exercise your rights, Agriness will ask for some additional information for the purpose of proving your identity, seeking to prevent fraud. We do this to ensure the data subject’s security and privacy.

Some requests may not be responded to immediately, but Agriness is committed to responding to all requests within a reasonable time and always in accordance with applicable law.

 

  1. What are your responsibilities as a data subject?

You are solely responsible for the accuracy, veracity and updating of the data provided. Agriness is not obligated to process or treat data, if there are reasons to believe that such processing or treatment could be attributed to any violation of any applicable law, or if the holder is using the Platform for any illegal, unlawful or contrary to morality purposes.

The holder is also responsible for the confidentiality of their personal data and must always be aware that their sharing violates this Notice and may jeopardize the security of their data and the Platform.

When you access our Platforms, you may be led, via a link, to other portals or platforms, which may collect your information and have their own data treatment policy. It is up to you to accept or reject the Privacy Policies of such portals or platforms outside our environment. We are not responsible for the Privacy Policies of third parties or for the content of any websites or services linked to environments other than ours.
